1. Overview and Information:

A Patent is a right granted by the Government of India for an invention which provides the right to the patent holder for a limited period to prevent others from manufacturing, selling or importing the invention without the permission or consent of the patent holder. The term of a patent is 20 years from the date of filing.

 

2. Patentability Assessment:

Unlike the pre-grant opposition, a post-grant opposition can only be filed by an interested party that too within 12 months from the date of grant of the patent.
